TERMS OF USE

Please read these Terms carefully. They set out the conditions that apply to your use of the RTA's online Accredited Assessor Reporting System ("System") for Older Driver Assessment. By using the System you thereby agree to abide by these Terms as modified from time to time by the RTA.

Only Authorised Users Can User the Accredited Assessor Reporting System

You must not log onto or use the System unless you are an Authorised User. A person will cease being an Authorised User if their authorisation is cancelled by the RTA or by their Employer.

Permitted Purpose

You can only use the System for the Permitted Purpose and only at your workplace. The Permitted Purpose is:

  • Undertaking an Eligibility Check to determine if a Customer is eligible to undertake an Older Driver Assessment ("Assessment") with you; or
  • Advising the RTA of the outcome of an Assessment you have carried out on a Customer.

Precondition and Restriction on Eligibility Checks

You must not attempt an Eligibility Check on anyone unless:

  • that person is making an application for an Assessment with you and you have read the RTA Privacy Statement to the Customer and the Customer has agreed to you making an Eligibility Check.

Confidentiality

Information concerning a Customer's eligibility for an Assessment and the outcome of their Assessment ("Customer Assessment Information") is confidential and personal information. You must not access it unless the Customer has agreed. You must not use it except for the Permitted Purpose. You must not disclose it to anyone else.

Password & Security

The RTA will allocate a User ID to you and will require you to create a Password. You must:

  • keep your Password secret and safe;
  • memorise your Password and not write it down;
  • not disclose your Password to anyone;
  • not disclose your User ID to anyone other than your Employer or your Employer's System Administrator;
  • immediately change your Password to a new one if you suspect that anyone else knows or may know your Password;
  • only log in using your own User ID;
  • not share User IDs or Passwords;
  • log out of the System whenever you are not using it or you are away from your computer.

The RTA may set rules from time to time about the types of Passwords that may be used and the frequency with which they must be changed and may at time require you to change your Password.

Misuse

You must immediately notify your Employer if you become aware of any suspected misuse of the System or Customer Assessment Information by anyone.

RTA Powers

The RTA may:

  • suspend your access to the System at any time if the RTA believes you may have breached these Terms
  • terminate your access to the System if you have breached these Terms
  • may monitor and record your use of the System to check your compliance with these Terms.
  • issue directions concerning the use of the System or RTA Customer Assessment Information and you must comply with them.

Breaches of these Terms

A breach of these Terms is a serious matter and may involve the following consequences:

  • A claim against you by the Customer under the Privacy Legislation for breach of privacy;
  • Action against you under the Independent Commission Against Corruption Act 1988 in respect of conduct that could adversely affect the honest or impartial exercise of official functions by the RTA;
    or
  • Prosecution under Part 6 of the Crimes Act 1900 in respect of unauthorised access or modification of data.

Dictionary

"Assessment" means that testing of an older driver's driving competency.

"Authorised User" is person who the RTA has authorised to use the System and issued a User to.

"Customer" means the holder of a NSW driver licence who applies to you for an Assessment.

"Customer Assessment Information" means information concerning a Customer's eligibility for an Assessment and the outcome of their Assessment

"Eligibility Check" means checking the System to ascertain whether or not the Customer is eligibile to undertake an Assessment with you.

"Employer" means your employer (normally the owner of a driving school) that the RTA has entered into a older driver assessment service provider agreement with.

"Privacy Legislation" means the Privacy and Personal Information Protection Act 1988 (NSW) and the Privacy Act 1988 (Cth) and any legislation that amends or replaces them.

"Privacy Statement" means the RTA-approved script that must be read to Customers before an Eligiblity Check is undertaken.
